These Terms and Conditions apply to all orders placed with Creative B Designs and supersede all other terms and conditions. Your receipt of Creative B Designs acknowledgment of any order placed by you constitutes your agreement that these Terms and Conditions are the only conditions that apply to any contract between you and Creative B Designs.
1. PRODUCTS
Creative B Designs reserves the right to alter the details of any products described on this website without notice. Whilst every effort is made to ensure that all information on this website is accurate, no warranty is given as to its accuracy and no responsibility will be accepted by Creative B Designs for any error or misinterpretation and/or any resulting loss. All images displayed on the Creative B website are purely for illustration purposes and the actual product colour or look may differ from said images.
2. CHANGES TO ORDERS
Any changes in the number of products ordered must be notified to Creative B Designs in writing before the commencement of processing of the order. If such notification is not received before the commencement of processing of the order, any increases in the number of products ordered will be regarded as a separate order.
3. DELIVERY
3.1 All deliveries by Creative B Designs will be charged at the rates quoted at the date of such delivery.
3.2 Whilst every effort will be made to deliver on time, no liability will be accepted by Creative B Designs for any loss arising from delay or error in the delivery of the products. In particular, Creative B Designs will accept no responsibility for missed deliveries due to non-payment for products. It is your responsibility to ensure that full payment is made to Creative B Designs before the delivery of all products.
3.3 For the avoidance of doubt, Creative B Designs will not be liable for any delay in delivery of the products caused by an event outside the control of Creative B Designs or for your failure to provide adequate delivery instructions or any other instructions relevant to the supply of the products.
4. RISK/TITLE
4.1 The risk in the products will pass to you on delivery of such products.
4.2 All products, whether or not delivered, will remain the property of Creative B Designs until payment is received in full by Creative B Designs for such products.
5. CANCELLATION/ON HOLD ORDERS
Cancellation of an order must be notified in writing to Creative B Designs. Any costs incurred for work already carried out up to the date of such written cancellation will be charged for and deducted before any refund is made to you. You will be liable for any Admin/Bank Fees on refunds that have to be made (Deductible from the amount paid). Orders for which an upfront payment has not been received, an invoice will be issued to you for the total amount due.
6. REFUNDS
Creative B Designs will not be held liable for any incorrect sizes ordered; sizes need to be checked beforehand as per the measurement chart.
Creative B Designs gives a guarantee on workmanship any defective products must be returned to Creative B Designs before replacement. If such products are not returned, Creative B Designs will assume that they have been accepted and no replacement will be provided. We will not accept any items that have been washed and used, all defective items will need to be returned before the item has been laundered.
We do not guarantee any fabrics only the workmanship.
Should Creative B Designs agree that a refund should be made to you, your account will be credited within three to four working days from such agreement.
7. CLAIMS
All products must be examined at the time of delivery Creative B Designs will not be liable for any loss arising from damage caused to products in transit unless such damage is noted on the delivery note at the time of delivery. All claims arising from damage to, delay or partial loss in transit of any products must be made in writing to Creative B Designs within 14 days of delivery of such products.
All claims regarding the quality or quantity of products shall be made in writing to The Bathrobe Company within 14 days of receipt of such products, or such products shall be deemed to comply as to quality and quantity with the original order.
8. LIABILITY
Creative B Designs liability for any loss or damage suffered by you in respect of the products supplied shall be limited to the total value of the original order relating to those products.
Creative B Designs will not accept any responsibility for loss or damage arising from the supply of products unless the notification of claims procedure set out in clause 7 has been followed.
Creative B Designs is not liable for any financial loss incurred by you, including but not limited to, expenses incurred by you, interest payments, and loss of earnings or similar gains you would have received on monies paid to us instead of any unfulfilled order.
Nothing in these Terms and Conditions shall affect your statutory rights as a consumer.
9. COPYRIGHT
9.1 The intellectual property rights in all materials on our site or available from it are owned by or licensed to Creative B Designs. You may download, print, and temporarily store for your personal use the pages on this website and material downloadable from it. You must not make any commercial use of any such material or otherwise use, copy, alter, re-transmit or permanently store any such material without our prior written consent. All other rights are reserved.
9.2 You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any diagrams, illustrations, photographs, or any graphics separately from their accompanying text.
9.3 If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
10. Limitation of our liability
10.1 To the extent permitted by law, we exclude all conditions, warranties, representations, or other terms which may apply to our site or any content on it, whether express or implied.
